Basseterre, St.Kitts (March 25th, 2019):- His Honor Justice Eddy Ventose has ruled that in favour of a challenge brought The motion brought against the constitutionality of the Public Service Code 9 which was introduced and passed by The Dr. Denzil Douglas led administration in 2011. The supporting regulations was tabled and passed in 2014 and laid out rules and regulations which prohibits civil servants from participating in politics.
Mr. Natta, a government employee, was suspended from duty in October 2018 when the Public Service Commission accused him of being actively involved with a political organisation, having introduced himself to a constituent as a political candidate.
Attorney Sylvester Anthony argued that Sections 36 and 38 of the Public Service Code 9, which was introduced and made law by the former Denzil Douglas administration, prohibit his client from participating in politics are “unconstitutional” as they prohibit public servants from expressing their freedom of speech, expression, and association.
Lawyers on the other side led by Douglas Mendez QC also agreed that the Dr. Denzil Douglas administration introduced law was unconstitutional .
Mr Natta, a Senior Officer at Customs, is seeking to engage in political activity and run for political office while remaining a public servant.
